In the early morning of April 3, 1981, the two men had a violent argument. According to Jim, Danny came by to borrow $20 to take Debbie on a date. Jim gave him the money, but Danny didn't leave. Instead, he got angry, saying that he'd spent the whole day working on his car with George Hill. Hill said he had no business with a car that he couldn't afford and that Danny should sell the car to George. Danny took it as an insult. Jim told Danny that George was his problem and not Jim's and walked away.

    Apparently, that wasn't the response Danny wanted, so he smashed a new marble-top table, threw a bronze lamp against the wall, and smashed some Chinese porcelain and ivory figures. Then he took a cut-glass water pitcher and slammed it on the floor. The pitcher blew up like a grenade, and shards of glass stuck in Danny's arms. Jim said he thought Danny had calmed down and left the house. Jim locked the door and went upstairs to brush his teeth. Suddenly, he said, he saw Danny in the bathroom door with a crazy look on his face and one of Jim's German Luger pistols in his hand.

    According to Jim, Danny asked, "How mad do I have to make you before you'll kill me?" and "Will this really shoot through the floor?" Then he shot a hole in the floor. When Jim tried to reason with him, he said Danny took the Luger and threw it from an upstairs window. Then he ran downstairs, grabbed another Luger that had been in the marble-top table he smashed, charged out into Monterey Square, and fired twice. Once Danny was out of the house, Jim called the police. Just as the police were coming into the square, Danny went back into the house, raced up the stairs, jumped into bed, pretended to sleep.

    When the police got him up and asked him if he'd broken up the furniture downstairs, Danny told them it was none of their business. One of the cops saw the bleeding on Danny's arms caused by the shards of glass from the broken water pitcher and challenged him, asking him to explain how he got cut. Danny responded belligerently. Jim told the cops he wanted to press charges, so they arrested Danny.

    The next day, Jim and Joe Goodman went to Judge Lionel Drew's Chatham County Recorder's Court. When Danny was brought up, Jim told the judge he was not going to press charges after all. He said that he thought that one night in jail would cure Danny a bit. Jim and Joe took Danny back to Mercer House, where they and Douglas Seyle started to clean up the mess from the night before.

    Danny was feeling very low. He told Jim, "Man, I just don't know what happened. Sometimes I just go blank. I'm going to sell my car to pay for the damages. Then he laughed and said, "I sure outsmarted the fat cop last night, didn't I?"

    "What do you mean?" Joe asked.

    "They almost got me," Danny said, "but I got on that bed, and I convinced them I was asleep."

    Debbie was dating Danny at the time, but she wasn't going out with him as much because he was "really starting to get on my nerves about this marriage thing all the time." She had a very different view of what caused the argument between Jim and Danny: Danny was jealous. On the night before the shooting, Debbie said that Danny was jealous because she had been at Mercer House drinking and playing dice with him and Jim. "He acted as if Jim was trying to put some moves on me, but he wasn't," she told an investigator. "Danny was super-jealous. God, I couldn't even look at or talk to anybody else when I was out with him and he got all mad about it.

    "Danny acted as though he could really shoot a gun fantastic," Debbie said, although she had never seen him with a gun. Danny told her that he pulled and shot one of the 9 mm Lugers at the house that night. "Danny thought it was funny. But he'd get strange, boy…You could see a personality change in him. For no reason at all. Ooooh, yeah. He'd get some weird look in his eyes and get this crazy smile when he was…I dunno. He was sort of psychotic-looking."

    For quite some time, Danny had been promising Debbie a gold chain necklace. She was so angry at what he had done to Jim on April 3 that she refused to see him for a week. He told her he was sorry. To make up for upsetting her, he was going to give her the necklace he had promised.

    Danny didn't have the money to buy the gold chain necklace and he was desperate to shore up his deteriorating relationship with Debbie, so he pressured Jim to buy the necklace. Danny told Jim he wanted a gold chain necklace for himself, similar to one that he seen Jim wear.

    Jim was quick to forgive Danny for the incident on April 3 and made reservations a week later, on April 10, to travel to London and Geneva with Danny on May 3. Jim suffered from hypoglycemia and was subject to fainting spells. Because Jim always took large sums of cash with him on his antiques-buying trips, he was concerned that he could be vulnerable to robbery.

    Once Danny understood that on this trip, he would have to dress in a suit and tie all the time and leave his marijuana at home, he decided he didn't want to go. Joe Goodman, who was willing to take some time off work, would go instead.

    Near the end of April, Jim bought the expensive (allegedly $400) necklace from a local jeweler and gave it to Danny, who then presented it to Debbie as something he had earned. Debbie told investigators that Danny deceived her and that much later she learned that Jim bought it for Danny.

    On either April 29 or 30, Danny and Debbie were at Mercer House. Debbie was wearing the new piece of jewelry. At that time, Debbie believed that Danny had paid for the necklace and did not see any indication that Jim was upset to see her wearing it. About the same time, Debbie said that Danny asked her to commit him to a mental institution because he felt he was going off the deep end.
